See attached comments of the Natural Resources Defense Council (NRDC) on the "Regulations Setting Minimum Standards and Requirements for Projects Funded Under the National Electric Vehicle Infrastructure (NEVI) Formula Program" (Proposed Standards) proposed by the Federal Highway Administration (FHWA) (Federal Register, Vol. 87, No. 119, Page 37262) in Docket No. FHWA-2022-0008. The agency staff who developed the Proposed Standards under the very aggressive timeline required by the Infrastructure Investment and Jobs Act (Infrastructure Law) are to be commended because the Proposed Standards would go a long way to creating a more uniform, reliable, and equitable charging experience across the 50 states. However, and perhaps understandably given the time constraint, the Proposed Standards fall short of meeting their stated goals in two important areas—payment and reliability. This view is held not just by NRDC, but by a diverse body of environmental, public health, equity, environmental justice, electric vehicle (EV) driver, consumer, and labor organizations, as well as the state governments which have had years of experience working on payment standards and reliability issues. The Administration should heed this collective input and borrow from those years of work and real-world experience to further President Biden's goal of ensuring drivers can reliably plug into increasingly clean electricity and easily pay for it at public charging stations in communities across the country.
