FR-6250-P-01    Dear HUD colleagues,    The Natural Resources Defense Council (NRDC) is pleased to respond to the Department of Housing and Urban Development's Request for Information re: Affirmatively Furthering Fair Housing Rule.   NRDC is an international, non-profit environmental and public health membership organization with more than three million members and online activists. NRDC advocates to reduce greenhouse gas emissions that cause climate change, increasing the resilience of communities to the unavoidable impacts of climate change, safeguard human health, and ensure safe drinking water for all.   The comments below address the structural and systemic barriers Black Indigenous People of Color (BIPOC) particularly those in low-income communities, continue to face in light of policy implementations that do not have equal outcomes for all. Our recommendations support the proposed rule and advocate for solution-oriented approaches that center community experiences at the core. Particularly those residents in economically disadvantaged neighborhoods.    We look forward to working with HUD to advance the AFFH rule. The nation needs a AFFH that is tailored towards assisting the communities who are struggling to rebuild and recover from housing discriminatory practices that stem from structural racism.   Thank you, Dr. Johnson

Abstract

FR-6519-I-01 This interim final rule revises HUD’s regulation governing the Fair Housing Act’s mandate that the Secretary administer HUD’s program and activities in a manner that affirmatively furthers fair housing. This interim final rule returns to the original understanding of what the statutory AFFH certification was prior to 1994— a general commitment that grantees will take active steps to promote fair housing. Grantee AFFH certifications will be deemed sufficient provided they took any action during the relevant period rationally related to promoting fair housing, such as helping eliminate housing discrimination. This interim final rule does not, however, reinstate the obligation to conduct an Analysis of Impediments or mandate any specific fair housing planning mechanism; program participants must continue to affirmatively further fair housing as and to the extent required by the Fair Housing Act.
