Abstract
The 2016 amendments to the Toxic Substances Control Act (TSCA) require EPA to establish a plan to review all claims to protect the specific chemical identities of chemical substances on the confidential portion of the TSCA Inventory that were asserted in a Notice of Activity (NOA) Form A. To accomplish that, EPA is proposing the procedures for substantiating an asserted confidentiality claim for specific chemical identity, if such substantiation was not provided at the time of the NOA Form A filing. EPA also is proposing the procedures by which EPA will review claims to protect the specific chemical identities asserted and substantiated.
