The Southern Environmental Law Center ("SELC") offers the attached comments in support of the U.S. Environmental Protection Agency's proposed denial of the application of the Alabama Department of Environmental Management (ADEM) for approval of the Alabama CCR permit program. These comments are submitted on behalf of SELC, Alabama Rivers Alliance, Coosa Riverkeeper, Black Warrior Riverkeeper, Mobile Baykeeper, Energy Alabama, Coosa River Basin Initiative, Chattahoochee Riverkeeper, Earthjustice, and the Sierra Club.

Abstract

Section 2301 of the Water Infrastructure Improvements for the Nation Act (WIIN Act) of 2016 amended Section 4005 of the Resource Conservation and Recovery Act (RCRA). The WIIN Act provides that States may, but are not required to, develop and submit a Coal Combustion Residuals (CCR) permit (or other system of prior approval) program to EPA for approval. The State of Alabama is seeking approval of its CCR permit program.
