The Southern Environmental Law Center ("SELC") offers the following comments on Addressing PFAS in the Environment. We strongly support EPA's proposal to designate per- and polyfluoroalkyl substances ("PFAS") as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act ("CERCLA"). As explained in the attached comments, we encourage the agency to promptly regulate PFAS as a class under CERCLA and, in the interim, move forward with the agency's proposal to list PFOA, PFOS, and seven additional PFAS, including their precursors, as hazardous substances. In addition, we urge the EPA to hold all polluters accountable and to refrain from creating unnecessary and damaging exemptions for wastewater treatment plants. These comments are submitted on behalf of SELC and 88 other environmental and community organizations.
