The undersigned organizations (Athens County's Future Action Network, CleanAIRE NC, Dogwood Alliance, Environmental Integrity Project, Mighty Earth, Natural Resources Defense Council, Sierra Club, and Southern Environmental Law Center) respectfully submit the following comments to the Department of the Treasury and the Internal Revenue Service (collectively, the "Department") in response to the Notice of Proposed Rulemaking for the Section 45Y Clean Electricity Production Credit and Section 48E Clean Electricity Investment Credit ("NOPR"). The Southern Environmental Law Center and Natural Resources Defense Council, together with other non-governmental organizations, initially submitted related comments in response to the Request for Comments on Certain Energy Generation Incentives (Notice 2022-49) under the Inflation Reduction Act ("Initial Comments"). Earlier this year, some of the undersigned organizations also submitted supplemental comments in response to Notice 2022-49 ("Supplemental Comments"). All arguments and evidence from the Initial and Supplemental Comments are incorporated by reference herein. Please see attached comment letter and its attachments.
