Weighted Selection Process for Registrants and Petitioners Seeking to File Cap-Subject H-1B Petitions

I believe the H-1B Visa program needs to be eliminated. I believe it has been detrimental to American workers and abused by greedy American companies. We simply must hold our citizens to higher academic standards and fill jobs first with American citizens. There are too many citizens on welfare and/or unable to find work. My 19 year old nephew has applied for over 1300 jobs and cannot get hired as a citizen. In America, for someone to desire to work and be willing to take anything and not be able to locate some kind of work is astonishing and signals a HUGE problem and a decline in US job opportunity reputation. What used to be referred to as the land of opportunity has now become opportunistic for ONLY those NOT American. This is an absolute travesty and this program should completely be eliminated and those visa holders deported in a timely fashion. Americans FIRST!

A weighted selection process is a favorable step in the sense that there is literally no need to admit applicants for entry-level positions. The unemployment rate of recent US citizen college graduates in STEM fields demonstrates this clearly. Further scrutiny of applications must take place at ALL levels. As a former IT employer, I was asked numerous times to facilitate H1B renewal applications "burying" job opening listings in obscure print media and padding requirements to fit the specific resume of the renewal applicant. THIS IS COMMON PRACTICE. And it comes at the recommendation and advice of H1B attorneys! Attorneys abusing the system like this should be barred from practice and all their applications automatically rejected. Thank you.

I oppose the continuation and expansion of the H-1B visa program. As a Texas resident, I am concerned that the program suppresses opportunities for qualified American workers—particularly those in our state's working and middle class. Texas has a strong and capable workforce that should be prioritized before employers turn to foreign labor pipelines. The structure of the H-1B program incentivizes companies to rely on lower-cost, less-empowered visa labor from foreigners instead of investing in American workers through competitive wages, training, and long-term career development. This creates downward pressure on wages, weakens job security, and undermines the economic mobility of Texans who are ready and able to fill these roles. I urge the legislature to take steps toward dismantling the H-1B system in its current form and refocusing policy on strengthening the local workforce. Texans deserve a labor market that puts American workers first and ensures that employment opportunities remain accessible to the people who call this state home.

I believe that time has passed! We must ensure that our own citizens are given priority. I highly recommend ending this practice all together. We have seen that this program is replete with fraud and abuse. The most important issue is that American citizen workers suffer a disadvantage at the expense of corporate policies and greed. It's time to eliminate this practice and concentrate on supporting Americans. At the very least, I hope that regulations will be put in place to drastically reduce the number of allotted H-1B visas! Let's give qualified Americans the opportunity and encouragement to fill these positions!

The H1B visa sounds good however how many American workers were laid off in order to hire a lower paid foreign worker? I know of a couple personally. A company should need to prove there are no qualified American workers for job and not have the American worker train the foreigner only to be laid off.

Congress created the H-1B visa in the Immigration Act of 1990 assuming that some temporary visas would be necessary to fill jobs until American workers could receive the education required to compete for some high-skilled jobs. However, this has not proven to be the result. Instead, H-1B visas are being used to replace qualified American workers with foreign workers, often at lower wages. As Vice President Vance pointed out: "You see some big tech companies where they'll lay off 9,000 workers, and then they'll apply for a bunch of overseas visas." President Trump wrote in his September 2025 proclamation: "The H-1B nonimmigrant visa program was created to bring temporary workers into the United States to perform additive, high-skilled functions, but it has been deliberately exploited to replace, rather than supplement, American workers with lower-paid, lower-skilled labor." As NumbersUSA points out, some of the problems with H-1B visas include: •According to the Department of Labor: "H-1B workers may be hired even when a qualified U.S. worker wants the job, and a U.S. worker can be displaced from the job in favor of the foreign worker." •Employers must demonstrate that they have tried to find qualified and interested domestic workers only after they sponsor their already-hired H-1B worker for a green card. •Employers commonly "demonstrate" that there are no domestic workers by placing job ads designed to get no responses. •The majority of H-1B workers are paid "entry level" wages. They are either not the best and the brightest, or they are woefully underpaid. The best solution to these issues would be the complete elimination of the H-1B visa program. The H-1B visas are hurting my industry and wages of my job. I got my degree in Electronics Engineering and I got a job at a large company making a good living. I was laid off 10 years later and started competing for low wage jobs doing the same work I had been doing for 10 years prior. When I found work after a year, it was $12 an hour. I was working with people from viet nam and Bosnia. Found another job making just a little more and working with people from Viet Nam, India and Mexico. I was having to train them because they had fake degrees and didn't have the knowledge they should have had. That's when I discovered the H-1B visas. Its not that companies can't find workers that are qualified, its that they can't find qualified workers for cheap. Americans want a good wage which compensates the high cost of the college degree. Companies like Nokia lay off the Americans and hire others from various countries for cheap. They aren't the best or brightest either. Their degrees are fake and their work isn't as good. I should be making a good living, but I'm making substandard wages. I still make just over half what I made 25 years ago. I should be making double, but the foreigners work for cheaper. We need to send them back to their countries. There are plenty of qualified, intelligent high end Americans to do high end jobs in the sciences, but we are forced into low wages and loss of our dreams. The middle class is being destroyed by foreigners taking our jobs. I love electronics, but unfortunately I can't make a good living in it anymore. Please do away with this H-1B visa program and give back the right of Americans to work those jobs at a decent competitive wage.

H1-B visas have decimated American jobs. I have personally known several people who had to train their foreign, lower paid replacements. There may be instances where companies legitimately need foreign talent. However, the primary motivator is greed. If we don't have American talent to do these jobs, why do China and India send their students to the U.S. for their education? From a national security perspective, many Chinese H1-B holders steal intellectual property for the CCP. This program needs a major overhaul.

Our neighborhood is being taken over by these visa holders and their chain migration. They do not assimilate, they don't even wave, say hello on a walk. Let's put Americans first, our customs and our values. Cancel these visas and let's see how many legitimate jobs can't be filled domestically.

These visas should be eliminated. They take many entry-level positions that could be filled by Americans.

The H1B visa program should be eliminated or greatly pared back. Currently there are far too many foreign workers being imported and they are competing for good paying jobs that should be FIRST filled by qualified Americans. If there must be a H1B program then it should as a minimum do the following: 1. Preference qualified Americans. Companies must look to hire American workers First! 2. Companies that receive government funds or have layoffs should not be eligible for H1Bs 3. The fee for H1B should be high enough that a company will not pay it unless absolutely needed. 4. Wages for H1B cannot be less than historical wages for that company or that industry. 5. There should be an annual cap on H1Bs, 100,000/year max and have thorough background checks. 6. H1Bs should be tied to the US unemployment rate. When unemployment is above 4% then H1Bs should be reduced or the fees increased substantially. We have to balance the needs of the American people first before we bring in foreign workers. In conclusion, I would love to see the H-1B Visa system completely eliminated. I believe there are plenty of well qualified Americans who could hold these jobs, and that the current system favors foreigners and does not support America First principles. While the weighted system is an improvement over the current random system, it could be improved by focusing on issues that protect American workers, and enhance the ability of American companies to thrive and be successful. We are importing hundreds of thousands of people from India. These people do not have skills that Americans do not have or can't learn. It is also concerning to import Chinese nationals for security reasons. If companies had lay-offs or receive federal funding, they should not qualify for H-1B Visas. I believe the program should be halted immediately. It is being abused and it is hurting Americans.

H-1B Visa program needs to be eliminated or overhauled. The new program proposes to replace the current random, lottery style of approving applications, to a more specific, weighted process that will target specific needs for workers. This new system, combined with President Trump's recent $100,000 fee on H-1B Visa applicant companies makes the whole process cumbersome, and expensive, and may functionally eliminate it. Put America to work first. According to an article by Centers for Immigration Studies, "DHS data shows that the H-1B program is neither used to bring "the best and the brightest" workers to the United States nor pay them fairly compared with their U.S. worker counterparts. The majority of H-1B registrations are proffered wages at Level 1 and Level 2, with only 28.53 percent of H-1B petitions received in fiscal years 2018 and 2019 filed for Level 4 and Level 3 wages. Under the current framework, lower wage level workers (i.e., workers with lower levels of experience, education, and/or skill) are able to crowd out workers with higher levels of experience, education, and/or skill from receiving visas." ALL H1B and various other Visas SHOULD expire and END! The foreign labor has destroyed the job market for American citizens! Blue collar jobs taken by illegals/farm Visas. The H1-B program should be eliminated entirely! Here are all the reasons why: Wage Suppression and Displacement of American Workers Studies (e.g., from EPI, Rutgers, and U.S. GAO reports) consistently show that H-1B workers are paid 10–25% less than comparable U.S. workers in the same roles and locations. Companies explicitly use H-1B to avoid hiring Americans at market rates. Notable cases: Disney (2015), Southern California Edison, Abbott Labs, Harley-Davidson, and dozens of outsourcing firms forced U.S. workers to train their lower-paid H-1B replacements as a condition of severance. In computer occupations (75%+ of H-1Bs), median H-1B wage is often at the 17th–25th percentile of U.S. wages for the same job title and location (DOL data). This is legal because the four wage levels are set artificially low. The Program Is Dominated by Outsourcing Companies, Not "Best and Brightest" Top H-1B employers (2024 data): Infosys, TCS, Cognizant, Amazon, Google, Microsoft, Deloitte, HCL, Accenture, Capgemini. The first seven are almost entirely outsourcing/body-shop firms. 60–70% of approved H-1Bs go to outsourcing companies that explicitly rent workers to third parties. The original 1990 law intended H-1B for companies bringing in talent they could not find domestically, not for labor arbitrage. Virtually No Enforcement or Labor Market Test Unlike every other developed country's skilled-worker visa, H-1B has no real requirement to prove an American was not available. The "labor condition application" (LCA) is a one-page online form with no verification. Employers are not required to recruit U.S. workers first for most H-1Bs (the PERM requirement only kicks in after green-card sponsorship, years later). Indentured Labor Effect H-1B workers are legally tied to the sponsoring employer for up to 6 years (sometimes longer). Leaving the job means immediate loss of legal status and deportation risk. This gives employers enormous leverage to underpay, overwork, and prevent whistleblowing. Multiple federal court cases and whistleblowers have documented sweatshop-like conditions at some outsourcing firms. Massive Oversupply and Gaming of the Lottery Annual cap is 85,000 new visas, but demand is 300,000–500,000 applications. Outsourcing firms file multiple applications per worker (some file 10–20 per person) to game the lottery, crowding out smaller employers. OPT/STEM extension loophole now adds another ~150,000–200,000 foreign graduates who can work unlimited hours with no cap and no labor protections. No Evidence of Overall Labor Shortage in STEM U.S. graduates ~2–3× as many STEM bachelor's degrees annually as there are STEM job openings (Census Bureau, NSF data). Real wages in software engineering have been essentially flat (inflation-adjusted) since the late 1990s despite explosive industry growth—classic sign of labor oversupply, not shortage. Countries like Germany, Japan, and Canada have far lower immigration rates in tech yet produce comparable innovation without wage stagnation. Green-Card Backlog Makes the "Temporary" Claim Fiction Indians (70%+ of H-1Bs) now face 100–200-year backlogs for green cards. Many workers stay on H-1B or H-1B-like status for 15–30 years, bringing families, buying houses—hardly "temporary." This creates a permanent underclass of highly skilled workers with fewer rights than citizens or green-card holders. National Security and Dependency Risks Heavy reliance on foreign nationals (especially from one or two countries) in critical tech infrastructure creates espionage and supply-chain risks. Huawei-related cases and recent Chinese-national espionage indictments at ASML, GE Aviation, etc., all involved H-1B or F-1/OPT workers. I am against H1B visas. They take jobs away from Americans.

Please shutdown the H-1B program or put a cap on the number of applications. The program is being abused and needs better management. It's out of control. There are plenty of educated US Citizens able and willing to go to work. The H-1B programs put the US citizen at the back of the bus, giving preferential treatment to foreigners. Hello and thank you for allowing me to comment on the subject of H-1B Visas. H-1B visas create an unfair playing field to American Workers. We need to eliminate this type of bias and I'm urging all representatives to fight to eliminate this and make America First. The future of our citizens ability to hold these jobs and support their families is at stake. They need to be engaged and productive, not sidelined due to unfair working environments. I am writing on H-1B and how it should be abolished. Do we know how much fraud and abuse there is in the giving of these visas. How about the information that is given for a visa and if it is really true or not. The companies should have to proof Americans can't do the work and then pay a good amount of money for the visas. The visas should have a limited time period and make sure it is followed. Companies like to make money and they should but not at the expense of being able to pay less for foreign workers. When Americans aren't hired, it puts a strain on the country in more ways than I think we really know! The visas give foreign countries the opportunity to get into our country and do we know why they want over here or are they planning another September 11th or just trying to take over our country! Please consider the damage H-1B visas are doing to America and more importantly Texans! These not only take away jobs from Americans, but often drives down the pay for others in the field. H-1B also brings entire families from other countries to benefit from what our citizens have worked hard to build and pay for. When you don't work for something, you can't appreciate it and will likely come to loathe it. If the concerns are that there are not enough Americans that are qualified, then why don't we focus on improving our education system? Why would we continue to shoot ourselves in the foot by bringing in foreigners to take our jobs, decrease our pay, crowd our housing, partake of our benefits and demoralize our citizens?
