Abstract
This proposed rule would create a safe harbor for group health plan administrators to provide documents and information electronically to participants and beneficiaries of plans subject to the Employee Retirement Income Security Act of 1974. This proposal would allow plan administrators in some cases to provide individuals with a notice that certain disclosures will be made available on a website. Individuals may request paper copies and opt out of electronic delivery. The Department expects that the proposal would make the disclosures more effective and reduce the burden of providing many recurring disclosures.
