Abstract

The EPA’s current water quality certification regulations were promulgated in 1971, prior to the 1972 amendments that enacted Clean Water Act section 401. On April 10, 2019, the President issued Executive Order 13868 titled “Promoting Energy Infrastructure and Economic Growth” which identified outdated regulations and guidance as causing confusion and uncertainty and hindering the development of energy infrastructure. The Executive Order instructed the Agency to review and revise existing regulations on section 401 for consistency with the policies in the Order and as appropriate and consistent with law. This action reflects the Agency’s review and revision of the existing section 401 regulations in accordance with the Executive Order. The Agency plans to finalize the regulations after reviewing public comments on the proposal.
