The American Frozen Foods Institute (AFFI) appreciates the opportunity to comment on the Environmental Protection Agency's (EPA) Renewable Fuel Standard Program: Renewable Fuel Standard Annual Rules. As the voice of the U.S. frozen food industry, AFFI is the national trade association that represents the interests of all segments of the frozen food industry. AFFI members manufacture and distribute frozen foods throughout the United States and globally, commodities that are critical at all times, but especially in the past two years as we have weathered a global pandemic. AFFI represents a broad group of companies throughout the food distribution chain, including food producers, distributors, and retailers that provide over 670,000 jobs. Soybean oil and other vegetable oils—which are used to make advanced biodiesel and renewable diesel—are a critical ingredient for many food manufacturers. EPA's proposal to increase advanced biofuel required volume obligations (RVOs) would result in diverting soybean oil, a critical ingredient for frozen food manufacturers, away from the food supply chain and toward the production of advanced biofuels. Existing domestic refining capacity for this commodity cannot keep up with the demand from both the food and fuel sectors, despite record soybean yields from America's hardworking farmers. This would endanger the ability for our members to meet the constant demand of providing millions of frozen foods to grocery stores, restaurants, and federal feeding programs. AFFI, therefore, encourages the EPA to decrease the proposed advanced biofuel quotas in order to protect an already fragile supply chain. Abstract

Docket for notice and comment rulemaking establishing the required volumes and percentage standards for 2021 and 2022 for various types of renewable fuels under the RFS program. This rule also responds to the court remand of the 2016 required volumes, proposes provisions for biointermediates, and proposes several other regulatory changes.
