January 18, 2005 Dockets Management Branch U.S. Department of Transportation 400 Seventh Street, SW Nassif Building, Room PL-401 Washington, DC 20590 Re: Research and Special Programs Administration; Docket No. RSPA-91-13289; Safeguarding Food From Contamination During Transportation Dear Sir or Madam: The American Frozen Food Institute (AFFI) welcomes the opportunity to provide comments with regard to the U.S. Department of Transportation’s (DOT’s) supplemental notice of proposed rule implementing the Sanitary Food Transportation Act of 1990 (SFTA). AFFI is the national trade association representing frozen food manufacturers, their marketers and suppliers. AFFI’s more than 500 member companies are responsible for approximately 90 percent of the frozen food processed annually in the United States, valued at more than $60 billion. AFFI members are located throughout the country and are engaged in the manufacturing, processing, transportation, distribution, and sale of products nationally and internationally. AFFI was actively involved in all stages of the legislative process that led to the enactment of SFTA. AFFI’s contributions resulted in the passage of a law that AFFI believes will promote the safe transportation of food. AFFI appreciates the hard work and dedication DOT staff has shown in implementing the SFTA. AFFI fully supports DOT’s tentative decision to cross reference the regulations of the U.S. Department of Agriculture (USDA) and the Food and Drug Administration (FDA) in developing regulations to implement SFTA. This decision ensures the safety of the American food supply while avoiding duplicative and unnecessary rulemaking.
