See attached Comment Letter submitted on behalf of the Association of American Railroads and the following member railroads: BNSF Railway Company; CSX Transportation, Inc.; Dakota Minnesota & Eastern Railroad Corporation, Delaware and Hudson Railway Company, Inc., and Soo Line Railroad Company (collectively d/b/a Canadian Pacific); Illinois Central Railroad Company; Norfolk Southern Railway Company; and Union Pacific Railroad Company.

Abstract

"Rulemaking pursuant to the September 2, 2014, Settlement Agreement Between the Association of American Railroads and the Occupational Safety and Health Administration to expand exemptions for certain railroad roadway work and related machine use; to remove requirements for operator training and certification; to provide alternatives to manufacturer approval of modified equipment use and operation so long as a qualified person or registered professional engineer approved the modified uses. The agreement was stamped by the court: Filed 09/09/2014, USCA Case #10-1386, Document #1511347."
